Erik Kapner joined Martin Clearwater & Bell LLP in 1981 and became a partner in 1988. Prior to joining MCB, Mr. Kapner was an Assistant District Attorney in the Manhattan District Attorney’s Office, handling all types of felonies from inception through verdict. In his career at the Firm, Mr. Kapner has tried over 100 medical malpractice cases to verdict, including many high exposure cases involving claims alleging significant injury or death. He has tried cases to verdict in the New York State Supreme Court in many counties ranging from Suffolk County throughout the Metropolitan area to Dutchess County.  He has also tried cases to verdict in the United States District Courts for the Southern and Eastern Districts of New York. He has defended many of the major hospital and teaching medical centers in the New York City area and has been formally recognized by a major hospital system for his successful defense of a number of difficult high exposure cases at trial. Mr. Kapner has earned the reputation among his peers as a tenacious trial lawyer and has repeatedly been listed as a New York Super Lawyer.

 

In addition to medical malpractice defense, Mr. Kapner has successfully represented corporate and individual clients in a broad range of litigation matters, trials and arbitrations, including but not limited to architectural, engineering and legal professional negligence suits and products liability.

 

Mr. Kapner received his J.D., with distinction, in 1975 from Hofstra University, where he was a member of the Hofstra Law Review. Mr. Kapner graduated magna cum laude from Queens College of the City University of New York in 1970 where he was elected to Phi Beta Kappa. Mr. Kapner is a member of the New York State Bar Association. He is AV® rated by Martindale-Hubbell® which is their highest rating.*
