Dental Malpractice

As dental procedures become more complex and invasive, dentists are coming under greater scrutiny and malpractice claims against them are rising. MCB is a proven leader in the defense of dentists, periodontists, endodontists, prosthodontists, orthodontists, dental hygienists, office assistants and other related professionals in this field for the last century. The Firm’s defense experience extends from informed consent issues of mini-dental implant  surgery and failure to diagnose oral cancer to dental procedures such as full mouth restorations.

As with the Firm’s other areas of malpractice, MCB attorneys are well versed in the various technical and scientific issues of dental malpractice, and its various specialties, and can provide the necessary defense tactics and assist these professionals with risk  management to help minimize claims. The Firm understands that a dental malpractice claim not only has the potential for financial repercussions, but also harm to a professional’s reputation and license.

MCB Result: Defense Verdict.

MCB obtained a defense verdict in New York County in a case where plaintiff claimed the defendant periodontist negligently performed a sinus lift resulting in a torn membrane and post-operative infection. The resulting defense verdict was a product of the MCB partner’s argument that the tearing of the membrane is often an unavoidable consequence of the procedure occurring in as many as one third of all sinus lift procedures.

MCB’s defense of these specialties encompasses a number of areas, including:

  • Malpractice Actions

  • Lack of Informed Consent

  • Investigations and hearings before the Office of Professional Discipline

  • Professional licensing and accrediting issues

  • Investigations and hearings before dental societies

  • Partnership and Employment Agreements

  • Business Contracts

  • Wage and Hour/Wrongful Termination
