Thomas A. Mobilia is a senior partner and trial attorney at Martin Clearwater & Bell LLP, who has defended major teaching hospitals, medical practices and individual physicians for 27 years in high exposure medical malpractice lawsuits. He has focused on defending neurosurgery, obstetrics, radiology, cardiothoracic surgery, and ophthalmology actions, amongst other complex areas of medical litigation. Mr. Mobilia has also represented pharmaceutical manufacturers in products liability actions involving generic drugs.
Mr. Mobilia is Co-Chair of the Healthcare Professionals Committee of the New York State Bar Association. He has represented physicians and healthcare professionals in disciplinary proceedings brought by the New York State Department of Health, Office of Professional Medical Conduct, and by the Office of Professional Discipline. Mr. Mobilia has also defended physicians and group practices in Federal False Claims Act litigation, Federal investigations, and audits by the Centers of Medicare & Medicaid Services. He has served as legal advisor to one of the largest Independent Practice Associations in New York State.
Mr. Mobilia’s many articles on medical malpractice litigation and healthcare law have been published in MD News, Case and Comment, PIAA: Inside Medical Liability, Cataract & Refractive Surgery Today, and MLMIC Dateline. He is a co-author of the Legal Manual for New York Physicians, Fourth and Fifth Edition, published by the New York State Bar Association and the Medical Society of the State of New York.
Mr. Mobilia is AV Preeminent® rated by Martindale-Hubbell®, which is their highest rating, and he is listed in the Bar Register of Preeminent Lawyers by Martindale-Hubbell®. Mr. Mobilia is the recipient of the 2015 Martindale-Hubbell Client Distinction Award®, and the Martindale-Hubbell Platinum Client Champion Award® in 2017, 2018 and 2019. Less than 1% of all attorneys have qualified to receive these awards. He has also been selected to New York Super Lawyers since 2010.
Mr. Mobilia is a frequent lecturer to various medical, surgical and nursing departments of major medical centers. He has been a Continuing Legal Education Lecturer on Medical Malpractice Defense and Litigation, and an Invited Speaker at Continuing Medical Education Programs. Mr. Mobilia has also been a Course Instructor on Ophthalmology Malpractice Defense at the 2012 Annual Joint Meeting of the American Academy of Ophthalmology, the Asia-Pacific Academy of Ophthalmology, and at the 2013-2017 Annual Meetings of the American Academy of Ophthalmology. He is a Continuing Legal Education Lecturer and Faculty Member of Lawline.
Mr. Mobilia is admitted to practice before the New York State Courts and the United States District Court, Southern and Eastern Districts of New York. He is a member of the American Bar Association, the New York State Bar Association, the New York State Medical Defense Bar Association, the American Health Lawyers Association and the Defense Research Institute.
